A 13 year old mentally and physically disabled boy, within a Bronx NYCHA Project, was tragically and severely burned as a result of hot water emanating from his bathtub. The water suddenly and without warning spiked in temperature causing second and third degree burns. Multiple skin grafts and physical rehabilitation were required to treat the injuries.

A 28 year old woman in a Bronx privately leased apartment suffered second degree burns to her chest and abdomen caused by scalding hot water splashing up from the kitchen sink. No surgeries were performed, but the woman was left with some residual scars.

A 50 year old union member fell from scaffolding at a Manhattan construction project. He sustained a fractured calcaneus, which caused him to miss 18 months of work. After summary judgment was awarded in his favor, the case settled during jury selection.

A 34 year old undocumented Carpenter’s Assistant, at a construction site in Brooklyn, fell one flight through an opening in a partially constructed floor. He suffered a meniscus (knee) injury requiring four surgeries. The case was settled after summary judgment had been won resulting in a “damages only trial”.

A 49 year old undocumented laborer fell from a ladder working construction on a Queens two-family home utilized as a doctor’s office. The hospital records documented a high blood alcohol level. A lumber laminectomy and lumbar fusion were ultimately performed. The case was settled while a summary judgment motion was pending.

A 32 year old unemployed Bronx man tripped on a defective sidewalk abutting a fast food franchise in the Bronx. He had pre-existing knee injuries but suffered herein a tibial plateau fracture and, ultimately, a total knee replacement.

A 67 year old woman tripped and fell on a defective sidewalk abutting a NYCTA subway grate in the Bronx. She suffered a fracture to her left ankle requiring surgery. NYCTA refused to settle based on the Ambulance Call Report (“ACR”) stating that the accident occurred differently than what the woman claimed. The EMS Technician, called by NYCTA, testified at trial consistent with his ACR. Despite such testimony, the jury returned a significant verdict without any finding of comparative negligence on the woman.

A 24 year old undocumented carpenter was injured while working in a pre-war furniture factory in Brooklyn. The freight elevator car failed to respond upon being called and the elevator doors opened exposing an open shaft. As he stepped backwards while pulling a metal container filled with wood debris, he fell 15 feet to the basement. He sustained bilateral calcaneal fractures which required five surgical procedures.

A 16 year old boy, who was working part-time for his dad’s design company in a Brooklyn factory, opened the elevator doors expecting the elevator car to be there, but it was not. He walked into the empty shaft sustaining fractures of the pelvis, wrist and ribs. Surgery was performed on the wrist.

A 5 year old boy suffered lead poisoning from lead paint at a Manhattan NYCHA Project. The lead level reached a high of 24 mcg/dl, which is in the lower span of the “high” range (20-44) set forth by the CDC. There was no treatment, no chelation therapy, and no hospitalizations. His lead level returned to normal after four months.

A 2 year old girl suffered lead poisoning from lead paint within her privately leased apartment. The lead level reached a high of 19 mcg/dl, which is considered in the “moderately elevated” range as set forth by the CDC. There was no treatment, no chelation therapy, and no hospitalizations. Her lead level returned to normal after four months.

A 44 year old man was injured in Suffolk County while driving straight through an intersection. The other driver made a left turn across his path of travel. There was an issue regarding who had the green light. There were no eyewitnesses. Our client sustained cervical fractures and required a laminectomy and cervical fusion.

A 30 year old undocumented deliveryman on his bicycle was struck by an undercover FBI vehicle in Manhattan. The case was commenced against the USA under the Federal Tort Claims Act, which does not permit jury trials. The injuries included a torn meniscus (knee) with surgery and a cervical fusion (albeit performed 2.5 years post-accident).
